1. General information

These terms and conditions (hereinafter the “Terms”) apply to all purchases made by the consumer via our website. “Consumer” means a natural person who primarily acts outside their trade or profession, cf. the Danish Sale of Goods Act. By placing an order with us, you accept these Terms. Service provider: Stella Care ApS (publisher of Care Tracker)

2. Products and prices

All prices are stated in DKK and include VAT and any applicable duties, unless clearly stated otherwise.

Any delivery costs are stated separately and added to the item price before you approve the order.

We reserve the right to change prices, offer discounts, or correct obvious pricing errors. Price changes only take effect for orders placed after the time of the change.

Product availability may vary, and we cannot guarantee that all items are in stock.

3. Ordering process

After you place an order, you will receive an order confirmation by email. The order confirmation is an automatic receipt acknowledging that we have received your order.

A binding purchase agreement is only concluded when you receive a dispatch confirmation from us, which constitutes acceptance of the order placed.

If a product is out of stock, or if issues arise with your order, we will contact you as soon as possible.

4. Payment methods

We accept the following payment methods: [Dankort, Visa, MasterCard.].

Payment is charged when the order is confirmed, unless otherwise agreed or stated by your chosen payment method.

Any fees (e.g., payment fees) will be clearly stated before you complete the purchase.

If you pay by payment card or another payment arrangement covered by the Danish Payments Act, you may in certain cases be entitled to have a payment reversed (right to dispute) by your provider pursuant to section 112 of the Danish Payments Act – e.g., if the item is not delivered, or if you have exercised a statutory right of withdrawal before the item is delivered.

5. Delivery

Delivery time varies depending on the chosen delivery method. Expected delivery time is 2–5 business days.

Shipping options and costs are shown at checkout.

If your delivery is delayed or lost, please contact us at [email protected]

We currently deliver to the following countries/areas: Denmark and the entire EU.

6. Right of withdrawal

As a consumer, you have a 14-day right of withdrawal for distance sales. The withdrawal period runs from the day on which you, or a third party designated by you (but not the carrier), takes physical possession of the item.

If you have ordered several different items in one order and they are delivered separately, the period runs from the day you receive the last item.

6.1 How to exercise the right of withdrawal
To exercise the right of withdrawal, you must, before the expiry of the withdrawal period, give us an unequivocal written notice that you wish to withdraw from the purchase, e.g., by email to [email protected].
You have met the deadline if you send the notice of withdrawal before the withdrawal period has expired.

6.2 Returning the item
After you have notified us that you wish to withdraw from the purchase, you must, without undue delay and no later than 14 days thereafter, return the item to the address we provide in connection with your enquiry.
As a general rule, you bear the direct costs of returning the item, unless otherwise expressly agreed in advance.
You are only liable for any diminished value of the item resulting from handling other than what is necessary to establish the nature, characteristics, and the way the item functions.
Please, where possible, return the item in its original packaging. Missing original packaging may, following a specific assessment, constitute a reduction in value that we may deduct from the amount you are refunded, but it is not a condition for the withdrawal to be valid.

6.3 Refund
When you withdraw from the purchase, we will refund all payments received from you for the relevant order, including any delivery costs (but not additional costs resulting from your choice of a delivery method other than the cheapest standard delivery we offer).1

The refund will be made without undue delay and no later than 14 days from the date on which we received your notice of withdrawal. However, we may withhold the refund until we have received the item back, or you have provided documentation that the item has been dispatched – whichever is earliest.

The refund will be made using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. You will not be charged any fees as a result of the refund.

7. Returns and exchanges

The provisions in this section apply where you wish to return or exchange an item in addition to your statutory right of withdrawal and right to make a complaint. Your statutory right of withdrawal under section 6 and your rights under the Danish Sale of Goods Act are not limited by this section.12

If you wish to return or exchange an item under this additional service, please contact our customer service at [email protected].

Items returned under this scheme must, as a general rule, be unused, show no signs of wear, and be in the original, undamaged packaging.

An exchange can be made if the desired item is in stock. If an exchange is not possible, we may, following a specific assessment, offer a refund or issue a credit note.

A refund under this voluntary scheme will be made to the same means of payment used for the purchase within 7 days after we have received and approved the returned item.

8. Complaints and claims

Your purchases are covered by the rules on defects in the Danish Sale of Goods Act. As a consumer, you have a 2-year right to make a complaint from the time of delivery. If you experience a defect or a problem with a product, please notify us within a reasonable time after you discovered or should have discovered the defect. A complaint made within 2 months after the defect is discovered is always considered timely. Contact us with a description of the fault at [email protected], after which we will guide you through the next steps.

If there is a defect, we will cover your reasonable costs in connection with return and remedy. Depending on the specific situation, you may, under the Danish Sale of Goods Act, be entitled to repair, replacement, a proportionate price reduction, or cancellation of the purchase.

9. Privacy policy

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the Danish Data Protection Act, as well as our current Privacy Policy, which is available here.

By using our webshop and services and by completing a purchase, you accept that we process your personal data to the extent necessary to administer your account, handle your order, delivery, payment, customer service, and to comply with our legal obligations.

The Privacy Policy describes, among other things, what information we collect, for what purposes, the legal basis for the processing, how long we retain the information, and what rights you have (access, rectification, erasure, restriction, objection, data portability, etc.).

We only disclose your personal data to third parties to the extent necessary to deliver the ordered goods/services (e.g., carriers and payment service providers) or to comply with legal obligations, or as otherwise stated in the Privacy Policy.

10. Limitation of liability

We are liable in accordance with the general rules of Danish law. Nothing in these Terms limits your rights as a consumer under mandatory legislation, including the Danish Sale of Goods Act and the Danish Product Liability Act.

To the extent permitted under mandatory law, our liability for loss is limited to direct loss that is a foreseeable consequence of the relevant breach. We are not liable for indirect loss, including operating loss, loss of profit, or loss of data, unless otherwise required by mandatory rules.

We strive to ensure correct and timely delivery, but we cannot be held liable for delays or defective performance due to circumstances beyond our control (force majeure). However, this does not exempt us from the obligations we have towards you as a consumer under mandatory law, and it does not limit your statutory remedies for breach.

11. Choice of law and disputes

These Terms are governed by Danish law.

Any disputes that may arise in connection with purchases via our webshop must be brought before the Danish courts as the agreed venue, unless otherwise required by mandatory rules.
